When you place an order, you are making an offer to purchase. Advanced 4x4 reserves the right to accept or decline your order for any reason at its discretion. Your order is not accepted until Advanced 4x4 confirms acceptance. We must receive and process your payment before your order is accepted. Please review your order carefully before submitting. In the event that we do not accept, make a change to, or cancel an order, we will attempt to notify you by contacting the email, billing address, and/or phone number provided at the time the order was made.
Once accepted, an order generally cannot be cancelled or amended on request, other than in accordance with our Return and Refund Policy — which includes your statutory right under Section 44 of ECTA to cancel an online order without reason or penalty within 7 days of delivery, and your rights under Section 56 of the CPA for defective goods.
You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.
Prices, discounts and promotions are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed and will be set out in your order confirmation email. Unless otherwise expressly stated, posted prices do not include taxes, shipping, handling, customs or import charges. Prices posted in our online store may differ from prices offered in physical stores or by third-party retailers. We may offer promotions from time to time that are governed by separate terms and conditions. If there is a conflict between the terms for a promotion and these Terms, the promotion terms will govern. We aim to deliver within the estimated timeframes shown at checkout. All delivery times are estimates only. We are not responsible for delays caused by circumstances outside our reasonable control, such as carrier disruptions or customs processing, though we will keep you informed and assist wherever we can.
Risk of loss. Under Section 19 of the CPA, the risk of loss or damage to your order remains with Advanced 4x4 until the goods are delivered to you — not from the point we hand them to a courier. If your order arrives damaged or is lost in transit, this is handled entirely under our Return and Refund Policy, and we manage any claim against the courier directly; you are never responsible for pursuing that claim yourself.
Our Services, including all trademarks, brands, text, displays, images, graphics, product reviews, video, and audio, and the design, selection, and arrangement thereof, are owned by Advanced 4x4, its affiliates or licensors and are protected by South African and international copyright, trademark and other intellectual property laws. These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store, or transmit any of the material on the Services without our prior written consent. Advanced 4x4's names, logos, product and service names, designs, and slogans are trademarks of Advanced 4x4 or its affiliates or licensors. This disclaimer does not apply to, and does not exclude, limit, or attempt to waive, your statutory rights in respect of any product you purchase from us, including the implied warranty of quality under Sections 55 and 56 of the CPA (which guarantees that goods will be of good quality, fit for purpose, and free of defects, and is not waivable by agreement), and our strict liability for harm caused by unsafe, defective, or hazardous goods, or inadequate instructions or warnings, under Section 61 of the CPA. Where any part of this section conflicts with those statutory rights, your statutory rights prevail.
To the fullest extent permitted by law, and subject always to Section 15 above, Advanced 4x4 excludes liability for indirect or consequential losses (such as lost profits or lost data) arising from your use of the Services' website functionality, where those losses did not result from a defect, hazard, or unsafe condition in a product we supplied.

Given the nature of the products we manufacture and sell — including structural vehicle components such as bumpers, rock sliders, and recovery points — we take this liability seriously and carry it accordingly.
You agree to indemnify, defend and hold harmless Advanced 4x4, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from losses, damages, liabilities, or claims, including reasonable legal fees, arising from (1) your breach of these Terms of Service, (2) your violation of any law or the rights of a third party, or (3) your misuse of the Services — in each case, only to the extent such losses were caused by you and not by any negligence, defect, or unsafe condition attributable to us.

You may not delegate, transfer or assign this Agreement or any of your rights or obligations under these Terms without our prior written consent, and any such attempt will be null and void. We may transfer, assign, or delegate these Terms and our rights and obligations without consent or notice to you, provided this does not reduce your rights under these Terms or the law.
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the Republic of South Africa.
For disputes above the jurisdictional limit of the Small Claims Court, you and Advanced 4x4 consent to the jurisdiction of the Western Cape High Court, Cape Town. This does not affect your right to instead pursue a claim through the Small Claims Court (where your claim falls within its monetary limit), the National Consumer Commission, the Consumer Goods and Services Ombud, or any other dispute resolution forum available to you under the CPA.
We reserve the right, in our sole discretion, to update, change, or replace any part of these Terms of Service by posting updates on this website. It is your responsibility to check this page periodically for changes. We will notify you of any material changes in accordance with applicable law. Your continued use of or access to the Services following the posting of any changes constitutes acceptance of those changes, provided that any order already placed remains governed by the Terms in effect at the time of that order.
